Official Rules

THREE WAYS TO ENTER: The Western Union® Mother of the Year Contest (the “Competition”), sponsored by Western Union (the “Sponsor”), starts April 17, 2009 at 12:00:01 a.m. ET and ends May 1, 2009 at 12:00:01 p.m. ET (the “Entry Period”). The individual who submits the Entry will be referred to herein as the “Entrant”. There are three ways to enter this Competition. 1) To enter online: go to www.Money4Mother.com or www.MejorMadre.com (each the “website”) and complete the Entry Form by providing your name, address, phone number, email address, your mother’s first and last name and her country of origin; then in 250 words or less tell us in an essay submission why your mother should be nominated as the “Mother of the Year” highlighting the reasons your mother is amazing and what you would do for your mother with the winnings. 2) To enter by phone: call toll free 1-866-408-6743 and record a voice submission reciting the required Entry Form information and the essay in 250 words or less as detailed above. When prompted, you must recite the Entry Form information and essay in 120 seconds or less. 3) To enter by written application: Complete an official Entry Form at a Western Union sponsored event in the U.S., where a Sponsor representative will collect your Entry Form and written submission in 250 words or less as detailed above and will enter you into the Competition. The third method of entry will only be available at select Western Union sponsored events, which will be held on April 19 in Atlanta, April 21 in Charlotte, April 22 and 25 in Washington D.C., April 23 in Boston, and April 24 in New York. Sponsor reserves the right to cancel or suspend the acceptance of written submissions at any Western Union sponsored event due to adverse weather conditions or other reasons beyond Sponsor’s control.

Essay submissions, voice submissions and written submissions are collectively referred to as submissions and all must include a completed Entry Form and essay. All forms of entries must be submitted by 12:00:01 p.m. ET on May 1, 2009. These are the only methods of entering this Competition.

ELIGIBILITY: Competition is open to all legal US residents 18 years of age or older, as of promotion start date, residing in the U.S. Failure to comply with these Official Rules will result in ineligibility of Entrant. Employees of Western Union, its affiliates, subsidiaries and agencies and their immediate family members or persons living in their household are not eligible. Competition is void where prohibited or restricted. Competition is subject to federal, state and local laws and regulations. Upon submission of an Entry, Entrant agrees to be bound by these Official Rules and the decisions of the judges which are final and binding. Entry limitations: one (1) Entry submission per Entrant, regardless of method of entry.

CONDITIONS OF ENTRY: Entrant warrants and represents that the submission is his or her original work, has not been written by a professional writer or previously won any prize or award. Modifying, enhancing or altering a third party’s preexisting work does not qualify as Entrant’s original creation. Each submission must be in keeping with Sponsor’s image and may not be obscene, indecent, harassing or otherwise offensive as determined by the Sponsor in its sole discretion; nor can any submission defame any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights, including but not limited to, intellectual property, privacy or publicity rights. Entrant warrants and represents that he or she has obtained all consents necessary to provide Sponsor with the submission and to grant to Sponsor the rights in the submission set forth below. Submissions that, in Sponsor’s sole discretion, are incomplete or do not comply with these Official Rules in any way are subject to disqualification and/or removal from the website or other media. No correspondence regarding submissions will be acknowledged or exchanged with Entrants except as provided herein. By providing a submission, Entrant grants to Sponsor the right to reproduce, distribute, display, perform, prepare derivative works, use, publish, adapt, assign, edit, dispose of and/or modify submissions and the concepts embodied therein in any way, in any and all media worldwide in perpetuity without any approval by or compensation to Entrant, and Entrant may be required to sign a release to that effect.

PRIZES: One Grand Prize will be awarded, and the winner will receive $50,000.00. Prize will be awarded in the form of a check in US $ payable to Entrant/winner name. Total prize payout $50,000.00. No substitution, transfer or assignment is permitted except at Sponsor’s sole discretion. Taxes and all other expenses are the sole responsibility of the winner. If winner is a minor in his/her State of residence, the prize will be awarded in the name of the winner’s parent/legal guardian.

JUDGING PANEL AND SELECTION CRITERIA: A panel of independent judges will review all valid Entries based upon the following judging criteria: Originality 40%, Sincerity/Credibility 30%, and Content 30%. The Entry with the highest score will be deemed the Grand Prize Winner, subject to verification. In the event of a tie, all tied Entries will be re-judged by an additional judge selected by Sponsor, who, using the judging criteria will break the tie. Sponsor reserves the right to disqualify and remove from the website and other media any submission that, in its sole opinion, refers negatively, depicts negatively or in any way reflects negatively upon the Sponsor, the Competition or any other person or entity. Sponsor is not obligated to use any submission. The judges’ decisions are final and binding in all matters relating to this Competition.

NOTIFICATION: Potential winner(s) will be notified by mail, email or phone and will be required to execute an Affidavit of Eligibility, a Publicity Release (except where prohibited by law) and an IRS W-9 form within three (3) days of notification and noncompliance will result in disqualification of Entrant. If any documents sent to a potential Winner by any means are returned as undeliverable or if potential Winner fails to properly execute and return all documents described herein in the time noted, or if a potential Winner is found not to be eligible or not in compliance with these Official Rules, the potential Winner will be disqualified and the judges will determine who will be selected as the alternate potential Winner based on the next highest scoring entry, as determined by the judges, and upon final approval of the judges. No more than the prize disclosed in these Official Rules will be awarded. By providing a submission, Entrant agrees to the use by Sponsor and its designees of Entrant’s name, city and state of residence, and photographs/likenesses for Sponsor’s advertising and promotional purposes, in any and all media worldwide in perpetuity without any approval by or compensation to Entrant except where prohibited by law. This Competition and these Official Rules shall be interpreted in accordance with the laws of New Jersey without regard to its principles of conflicts of law. Jurisdiction and venue shall be solely within the State of New Jersey.

RELEASE OF LIABILITY: By providing a submission, Entrant agrees to indemnify and hold harmless Sponsor and waive any and all claims of liability of any kind against Sponsor from (1) any accident, loss, injury or death occurring from this Competition, and (2) Entrant’s breach of any covenant, condition, representation or warranty in these Official Rules. Entrants agree that the Sponsor is not responsible for: (1) any problems or technical malfunctions; (2) failed or unavailable hardware, network, software or telephone transmissions; or (3) Entries submitted in a manner not expressly allowed under these Official Rules. Sponsor reserves the right, at its sole discretion, to cancel or suspend this Competition should virus, bugs, fraud or other causes beyond the control of the Sponsor corrupt the administration or proper play of the Competition and in such cases award the prize based upon the eligible, non-suspect Entries received prior to the date of cancellation/suspension. Caution: Any attempt by an individual to deliberately damage the website or undermine the legitimate operation of this Competition may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to disqualify and seek damages from any such individual to the fullest extent permitted by law.

GENERAL RULES: If Entrant is a minor in his or her state of residence, then Entrant’s parent or legal guardian must agree to these Official Rules on the minor’s behalf. Sponsor reserves the right to terminate, withdraw or amend the Competition or Official Rules for any reason at anytime without notice to Entrants.

PRIVACY: The personal information Entrants submit when entering the Competition is collected by Sponsor and will be subject to Western Union’s Privacy Statement (“Statement”). Sponsor may disclose Entrant’s personal information to third parties as explained in the Statement. To obtain a copy of the Statement, visit Western Union’s website at www.westernunion.com or call 1-800-562-2598 and ask for a copy of Western Union’s Privacy Statement. Information disclosed to third parties may include without limitation financial background information, identification information such as Entrant’s name and address, transaction information and other information relating to financial matters. Third party recipients of Entrants’ personal information may include without limitation financial institutions, retailers, companies that process transactions or provide services for Sponsor, government agencies and direct marketers. Entrants may opt out of (meaning direct Sponsor not to make) certain disclosures by calling 1-800-562-2598. If Entrant does not opt out of having their personal information shared with third parties then Entrant has agreed to have his/her personal information used as the Statement describes.

WINNER’S LIST: The prize winner will be listed on www.Money4Mother.com, www.MejorMadre.com and www.westernunion.com at the conclusion of the Competition and will remain displayed for 30 days from date posted. The winner’s name may also be obtained by calling 1-866-408-6743.
